Summary: | Examines legislative options in wake of Supreme Court ruling in Citizens United v. FEC, which struck down longstanding prohibitions on corporations using their general treasury funds to make independent expenditures and on corporations and labor unions from using general treasury funds for "electioneering communications;" determining that these prohibitions constituted a ban on First Amendment right to free speech. Analyzes constitutional and legal issues raised by specific proposals, including increasing disclaimer requirements, increasing disclosure for tax-exempt organizations, requiring shareholder notification and approval, restricting U.S. subsidiaries of foreign corporations, restricting political expenditures by government contractors and grantees, taxing corporate independent expenditures, and providing public financing for Congressional campaigns. Discusses Congressional proposals to amend the Constitution following Citizens United v. FEC. |
