Summary: | Discusses P.L. 109-8, the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) of 2005, to prevent abusive or opportunistic bankruptcy petitions and to require debtors with regular incomes to repay at least part of what they owe. Assesses impact of BAPCPA upon proportion of Chapter 13 petitions, where debtors repay creditors out of future income, under court-approved plan; and examines impact of BAPCPA on Chapter 7 petitions, where debtor assets are liquidated and certain debts are discharged, or erased. |
