Summary: | The Third Parties Act 1930 is designed to enable a claimant to proceed directly against an insurer when the insured defendant becomes insolvent. However the Act is unsatisfactory in practice and causes unnecessary litigation and expense and does not take into account all of the new insolvency legislation. This report recommends a new Act and presents a draft Bill. The key proposals are: a new streamlined procedure to allow single proceedings against the insurer; improved rights to information about the insurance policy; the inclusion of legal expenses and health insurance cover; removing difficulties with "voluntary arrangements". |
