Description
Summary:In recent years, the number of legal proceedings before German courts involving foreign parties has dramatically increased. Due to its new Arbitration Act, Germany also is becoming more and more established as a seat for international arbitration proceedings. The book covers the essential features of German civil procedure and arbitration law as well as the growing field of alternative dispute resolution. It describes, inter alia, the typical course of a lawsuit before a German court involving a foreign party, addressing questions of international service of process, taking of evidence, recognition and enforcement. Additionally, the reader becomes acquainted with the practice of German and international arbitration law and practice. The book further contains an overview of the alternative dispute resolution mechanisms in use in Germany including mediation. The work provides quick access to the issues significant for practical purposes, in particular to foreign readers. The authors are attorneys at the international law firm Gleiss Lutz and are recognized experts in the field of litigation and arbitration. They advise and represent German and foreign companies in proceedings before German courts as well as before national and international arbitral tribunals and are well published in this field.
