Summary:Describes and analyzes 2009 Federal circuit court decision requiring a per-article penalty for false patent marking, and reviews two subsequent Federal circuit decisions in 2010 that respond to several questions that arose during recent false patent marking litigation. Examines legislation in the 111th Congress that would amend the Patent Act to retroactively end qui tam false marking suits and to reduce number of false marking suits filed in the future.
