Summary:Examines issues surrounding Federal habeas corpus, the statutory procedure under which Federal courts may review State and Federal convictions and sentences to determine whether they are contrary to the laws or the Constitution. Reviews previous Federal habeas corpus reform, and provides an analysis of Federal habeas corpus petition data since 1990. Discusses 109th Congress legislation to further restrict State prisoners' access to Federal habeas corpus filings, including S. 1088 and H.R. 3035, both the Streamlined Procedures Act of 2005, to reduce delays in habeas corpus proceedings. Analyzes two dominant issues at the center of the Federal habeas corpus debate delays caused by habeas corpus petitions and post-conviction representation.
