Summary:What do we mean by 'negligence' and why are we responsible for our negligent actions? This book reconstructs our linguistic, moral and legal usage of the concept of negligence and demonstrates that there is an overarching, intrinsically normative concept underlying our evaluative practices of ascribing negligence. Philosophical action theory provides the means to spell out the conditions under which we can speak of 'negligent actions'. In line with Joseph Raz the author concludes that to solve the 'problem of negligence', i.e. to justify moral and legal responsibility for all cases of negligence we have to take recourse to a specific conception of an agent's 'rational functioning'.
