Notes:"That, said petitioners represent, that the Pennsylvania and Ohio Canal Company was incorporated to construct a canal from Akron, in the State of Ohio, to Beaver, in the State of Pennsylvania, with full and ample powers to use the lands, waters, and other materials, necessary to its construction; that said company has already caused the whole Cuyahoga river to be brought from its original bed, onto the summit at Ravenna; that one of the engineers of said company has declared this stream to be amply sufficient to supply said canal with water; that said company are now taking admeasurments, and making estimates for the erection of a dam to throw the waters of the Breakneck into Muddy and Sandy Lakes, for the ostensible purpose of raising tho level of those Lakes, and using them as reservoirs, in supplying said canal with water, but in reality to create a surplus of water for hydraulic purposes and private speculation; that the waters of said stream and Lakes are proverbially unhealthy, and that the construction of said dam and reservoirs would produce sickness and disease among the inhabitants residing within their influence, and therefore, pray this Legislature to grant no further extension of time or power to said company, and that their present powers may be curtailed and limited to the legitimate objects for which they were granted."--Page 3.

The committee thus concluded the petitioners could withdraw their petition as premature.
